Under Cybercrime Law"},"content":{"rendered":"\n<p><em>On June 7, Niger\u2019s head of state Abdourahamane Tchiani, seen here declaring himself the country&#8217;s leader after a July 2023 coup, reintroduced prison sentences and fines for defamation and insult via electronic means of communication, news reports said. |File Photos|<\/em><\/p>\n\n\n\n<p>Nigerien authorities reintroduced prison sentences for defamation, insults, and dissemination of data likely to disturb public order via social networks.<\/p>\n\n\n\n<p>According to the Nigerien authorities, this decision was taken to restore the balance between freedom of expression and the protection of individual rights, as well as to preserve public peace and security.<\/p>\n\n\n\n<p>Under Article 29 of Cyber Crime Law, anyone found guilty of defamation or insult via an electronic communication medium could now be sentenced to between one- and three years imprisonment and a fine of between one and five million CFA francs (1,643.86 and 8,000 US Dollars)<\/p>\n\n\n\n<p>The Committee to Protect Journalists called on the Nigerien authorities to decriminalize defamation and ensure that the country\u2019s cybercrime law does not unduly restrict the work of the media.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"780\" height=\"520\" src=\"https:\/\/goldentimessouthsudan.com\/wp-content\/uploads\/2024\/06\/Junta-Niger-02-webscreenshot-RTN.jpg\" alt=\"\" class=\"wp-image-651\" style=\"width:468px;height:auto\" srcset=\"https:\/\/goldentimessouthsudan.com\/wp-content\/uploads\/2024\/06\/Junta-Niger-02-webscreenshot-RTN.jpg 780w, https:\/\/goldentimessouthsudan.com\/wp-content\/uploads\/2024\/06\/Junta-Niger-02-webscreenshot-RTN-300x200.jpg 300w, https:\/\/goldentimessouthsudan.com\/wp-content\/uploads\/2024\/06\/Junta-Niger-02-webscreenshot-RTN-768x512.jpg 768w, https:\/\/goldentimessouthsudan.com\/wp-content\/uploads\/2024\/06\/Junta-Niger-02-webscreenshot-RTN-696x464.jpg 696w\" sizes=\"(max-width: 780px) 100vw, 780px\" \/><\/figure>\n\n\n\n<p>On June 7, Niger\u2019s head of state Abdourahamane Tchiani, who overthrew the democratically elected president in July 2023, reintroduced prison sentences of one to three years and a fine of up to 5 million CFA francs (US$8,177) for defamation and insult via electronic means of communication, according to news reports.&nbsp;<\/p>\n\n\n\n<p>A jail term of two to five years and a fine of up to 5 million CFA francs (US$8,177) were also set for the dissemination of \u201cdata likely to disturb public order or undermine human dignity,\u201d even if such information is true, according to CPJ\u2019s review of a copy of the law.&nbsp;<\/p>\n\n\n\n<p>\u201cThe changes to Niger\u2019s cybercrime law are a blow to the media community and a very disappointing step backward for freedom of expression,\u201d said CPJ Africa Program Coordinator, Muthoki Mumo, in Nairobi.&nbsp;<\/p>\n\n\n\n<p>\u201cIt is not too late to change course by reforming the law to ensure that it cannot be used to stifle journalism.\u201d<\/p>\n\n\n\n<p>Previously, the crimes of defamation and insult were punishable with fines of up to 10 million CFA francs (US$16,312), while dissemination of data likely to disturb public order carried a penalty of six months to three years imprisonment.<\/p>\n\n\n\n<p>The government abolished criminal penalties for defamation and insult in 2022 to bring the 2019 cybercrime law&nbsp;into line with the 2010 press freedom law.<\/p>\n\n\n\n<p>On June 12, Niger\u2019s Minister of Justice and Human Rights Alio Daouda said in a statement&nbsp;that the 2022 amendments were made \u201cdespite the opposition of the large majority of Nigeriens.\u201d<\/p>\n\n\n\n<p>He said that decriminalization of the offenses had led to a \u201cproliferation of defamatory and insulting remarks on social networks and the dissemination of data likely to disturb public order or undermine human dignity\u201d despite authorities\u2019 calls for restraint.<\/p>\n\n\n\n<p>\u201cFirm instructions have been given to the public prosecutors to prosecute without weakness or complacency\u201d anyone who commits these offenses, he said.<\/p>\n\n\n\n<p>CPJ and other press freedom groups have raised concerns about journalists\u2019 safety in the country since the 2023 military coup.&nbsp;<\/p>\n\n\n\n<p>This April, Idrissa Soumana Maiga, editor of the privately owned L\u2019Enqu\u00eateur newspaper, was arrested and remains behind bars on charges of undermining national defense.
