{"id":1887,"date":"2026-04-17T09:54:19","date_gmt":"2026-04-17T09:54:19","guid":{"rendered":"https:\/\/goldentimessouthsudan.com\/?p=1887"},"modified":"2026-04-17T09:55:32","modified_gmt":"2026-04-17T09:55:32","slug":"south-sudan-cybercrime-law-sparks-press-freedom-fears","status":"publish","type":"post","link":"https:\/\/goldentimessouthsudan.com\/index.php\/2026\/04\/17\/south-sudan-cybercrime-law-sparks-press-freedom-fears\/","title":{"rendered":"South Sudan Cybercrime Law Sparks Press Freedom Fears"},"content":{"rendered":"\n<p class=\"has-text-align-right\"><sub><sup>President Salva Kiir is seen signing the Cybercrimes and Computer Misuse Law.<\/sup><\/sub><\/p>\n\n\n\n<p><sub>Friday, April 17, 2026 | Author \u2013 Alex Onyango | Nairobi-Kenya | Photo: PPU-South Sudan |\u00a0GT-News |<\/sub><\/p>\n\n\n\n<p>A newly enacted cybercrime law in South Sudan is drawing sharp criticism from press freedom advocates, who warn it could be used to silence journalists and criminalise legitimate online speech.<\/p>\n\n\n\n<p>The Committee to Protect Journalists (CPJ) has called on authorities in Juba to urgently review the\u00a0Cybercrimes and Computer Misuse Act, 2026, arguing that several of its provisions are vague, overly broad, and open to abuse.<\/p>\n\n\n\n<p>The law, signed by President Salva Kiir in February, introduces penalties of up to\u00a0five years in prison for defamation and publishing \u201cfalse or misleading\u201d information\u2014a move critics say contradicts international human rights standards.<\/p>\n\n\n\n<p>\u201cIn its current form, the Act presents a risk of potential misuse and self-censorship,\u201d said James Bidal, a South Sudanese human rights activist and head of the South Sudan Human Rights Defenders Network.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Vague language, sweeping powers<\/strong><\/h3>\n\n\n\n<p>Central to the concern are provisions that criminalise undefined categories such as\u00a0\u201cundesirable content\u201d\u00a0and\u00a0\u201cfalse or misleading information.\u201d\u00a0Critics argue these terms could be interpreted subjectively, leaving journalists and citizens vulnerable to prosecution.<\/p>\n\n\n\n<p>The law also grants significant powers to the National Communication Authority, including the ability to access \u201cany\u201d user data deemed necessary\u2014without judicial oversight.<\/p>\n\n\n\n<p>Other provisions raise alarm:<\/p>\n\n\n\n<ul>\n<li>Publishing information that causes \u201cpublic panic\u201d or harms reputations could lead to\u00a0five years in jail<\/li>\n\n\n\n<li>Platform administrators may face prison for failing to remove vaguely defined unlawful content<\/li>\n\n\n\n<li>\u201cOffensive communication\u201d and \u201ccyber harassment\u201d carry criminal penalties, with broad definitions<\/li>\n\n\n\n<li>\u201cCyberbullying\u201d offences could result in sentences of up to\u00a010 years imprisonment<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Regional trend reversed<\/strong><\/h3>\n\n\n\n<p>The legislation stands in contrast to a growing trend across Africa, where countries including\u00a0Kenya, Ghana, Sierra Leone, and South Africa\u00a0have moved to abolish criminal defamation laws.<\/p>\n\n\n\n<p>International bodies such as the United Nations and the African Commission on Human and Peoples\u2019 Rights have long advocated for\u00a0decriminalising defamation, arguing that imprisonment for reputational harm violates freedom of expression.<\/p>\n\n\n\n<p>\u201cSouth Sudan\u2019s 2026 cybercrimes law is fundamentally flawed,\u201d said CPJ Africa Programme Coordinator Muthoki Mumo.<\/p>\n\n\n\n<p>\u201cAuthorities need to go back to the drawing board to tackle cybercrime without undermining press freedom.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>A hostile climate for journalists<\/strong><\/h3>\n\n\n\n<p>South Sudan already has one of the most challenging environments for journalists in the region. Since gaining independence in 2011, media workers have faced\u00a0censorship, arbitrary detention, and intimidation.<\/p>\n\n\n\n<p>According to CPJ,\u00a0at least 10 journalists have been killed since 2012.<\/p>\n\n\n\n<p>In 2025, authorities temporarily\u00a0suspended social media access\u00a0and blocked an online news outlet, further raising concerns about shrinking civic space.<\/p>\n\n\n\n<p>With the new law in place, critics fear the risks to journalists\u2014and ordinary citizens\u2014could deepen.<\/p>\n\n\n\n<p>Government officials say the legislation is aimed at tackling\u00a0online fraud and digital abuse, but have yet to publicly respond to the growing backlash.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Salva Kiir is seen signing the Cybercrimes and Computer Misuse Law.
