{"id":1784,"date":"2026-03-09T07:42:58","date_gmt":"2026-03-09T07:42:58","guid":{"rendered":"https:\/\/goldentimessouthsudan.com\/?p=1784"},"modified":"2026-03-09T07:42:59","modified_gmt":"2026-03-09T07:42:59","slug":"kenya-court-strikes-down-sections-of-cybercrime-law","status":"publish","type":"post","link":"https:\/\/goldentimessouthsudan.com\/index.php\/2026\/03\/09\/kenya-court-strikes-down-sections-of-cybercrime-law\/","title":{"rendered":"Kenya Court Strikes Down Sections of Cybercrime Law"},"content":{"rendered":"\n<p><em><sub>Monday, 9 March 2026 | Author \u2013 Alex Onyango | Nairobi-Kenya | <em>Screenshot: NTV Kenya\/YouTube<\/em> | GT-News |<\/sub><\/em><\/p>\n\n\n\n<p>Kenya\u2019s Court of Appeal has struck down key provisions of the country\u2019s 2018 cybercrime law that criminalized the publication of \u201cfalse\u201d or \u201cmisleading\u201d information online, in a ruling welcomed by media freedom advocates as a major step for freedom of expression.<\/p>\n\n\n\n<p>The decision followed a legal challenge filed by the Bloggers Association of Kenya (BAKE), which contested 26 provisions of the\u00a0Computer Misuse and Cybercrimes Act, 2018, arguing that the law was vague, lacked a clear requirement of criminal intent, and violated constitutional protections for freedom of expression, media freedom, and privacy.<\/p>\n\n\n\n<p>In its ruling, the appellate court declared\u00a0Sections 22 and 23\u00a0of the law unconstitutional. The judges said the provisions, which criminalized publishing \u201cfalse, misleading, or fictitious data,\u201d were overly broad and could unfairly target innocent citizens.<\/p>\n\n\n\n<p>The court described the provisions as \u201cso broad, wide, untargeted, akin to unguided missiles,\u201d warning that they could easily be used to suppress legitimate speech and would also be difficult to prove in court.<\/p>\n\n\n\n<p>The\u00a0Committee to Protect Journalists (CPJ)\u00a0welcomed the decision, saying the provisions had often been used by powerful individuals to silence critical reporting and commentary.<\/p>\n\n\n\n<p>\u201cThe Court of Appeal\u2019s decision to nullify legal provisions criminalizing the publication of false news is a significant win for the media,\u201d said\u00a0Muthoki Mumo, CPJ\u2019s Africa Program Coordinator. She added, however, that reforms are still needed, particularly regarding sections of the law that impose harsh penalties for the vaguely defined offense of cyber harassment.<\/p>\n\n\n\n<p>While striking down the two provisions, the\u00a0three-judge bench upheld the rest of the law, rejecting claims that it grants authorities unchecked surveillance powers or violates privacy rights.<\/p>\n\n\n\n<p>The court also upheld\u00a0Section 27, which criminalizes cyber harassment and carries a penalty of up to\u00a010 years in prisonfor sending communications deemed \u201cindecent,\u201d \u201cgrossly offensive,\u201d or detrimental to the recipient.
