{"id":1475,"date":"2025-05-07T19:18:14","date_gmt":"2025-05-07T19:18:14","guid":{"rendered":"https:\/\/goldentimessouthsudan.com\/?p=1475"},"modified":"2025-05-07T19:20:53","modified_gmt":"2025-05-07T19:20:53","slug":"un-says-recent-bombing-of-msf-hospital-constitutes-a-war-crime","status":"publish","type":"post","link":"https:\/\/goldentimessouthsudan.com\/index.php\/2025\/05\/07\/un-says-recent-bombing-of-msf-hospital-constitutes-a-war-crime\/","title":{"rendered":"UN says recent bombing of MSF hospital constitutes a war crime"},"content":{"rendered":"\n<p class=\"has-text-align-right\"><em>Yasmin Sooka, chairperson of the UN Human Rights Commission (this commission was formed to investigate the human rights abuses in South Sudan). |Credit: United Nations|.<\/em><\/p>\n\n\n\n<p><strong>Wednesday, 7 May 2025<\/strong><\/p>\n\n\n\n<p>The UN Commission on Human Rights in South Sudan condemned in the strongest terms the deliberate aerial bombing of a M\u00e9decins Sans Fronti\u00e8res (MSF) hospital in Old Fangak, Jonglei State &#8211; an atrocity crime that may constitute a grave breach of international humanitarian law and a war crime.<\/p>\n\n\n\n<p>The early morning airstrike on Saturday, 3 May 2025, obliterated the hospital, killing at least seven civilians and injuring many, including patients, caregivers, and medical staff.<\/p>\n\n\n\n<p>The attack destroyed critical medical infrastructure and the hospital\u2019s pharmacy, cutting off tens of thousands from critical lifesaving care.<\/p>\n\n\n\n<p>Credible reports confirm further aerial bombardments in the Phom area of New Fangak in the early hours of 5 May 2025, where bombs reportedly fell between an INGO compound and the County Commissioner\u2019s office.<\/p>\n\n\n\n<p>\u201cThis was not a tragic accident. It was a calculated, unlawful attack on a protected medical facility. The aerial bombing of the MSF hospital in Old Fangak is a flagrant war crime, under&nbsp; international law,\u201d said&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/hrc\/co-h-south-sudan\/bio#sooka\" target=\"_blank\" rel=\"noreferrer noopener\">Yasmin Sooka<\/a>, Chair of the Commission.<\/p>\n\n\n\n<p>\u201cTargeting medical facilities and services violates the Geneva Conventions and represents a direct assault on foundations of humanitarian action that are intended to protect civilians in conflict zones. Those responsible must be identified, investigated, and held accountable without delay\u201d, she stated.<\/p>\n\n\n\n<p>The attack followed a public statement by the spokesperson of the South Sudan People\u2019s Defense Forces (SSPDF) on Friday, 2 May 2025, ordering retaliatory military action if hijacked vessels at Adok Port in Leer County were not immediately released by armed elements.<\/p>\n\n\n\n<p>The SSPDF warned that failure to comply would result in punitive aerial and riverine operations. This threat was issued shortly after the Government, in a strategic public announcement, categorized Nuer-majority counties by ethnicity into \u2018hostile\u2019 and \u2018friendly\u2019\u2014naming Fangak, home to tens of thousands of Nuer civilians, as one of nine \u2018hostile\u2019 counties in its document titled&nbsp;<em>The Strategic Response of the Revitalized Transitional Government of National Unity (R-TGoNU) to the Nasir Incident<\/em>.<\/p>\n\n\n\n<p>\u201cThis strike does not seem to be an isolated incident\u2014it occurred in the context of escalating ethnic profiling, unlawful detentions, and a hardening of positions within the political and military elite,\u201d said Commissioner&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/hrc\/co-h-south-sudan\/bio#afako\" target=\"_blank\" rel=\"noreferrer noopener\">Barney Afako<\/a>. \u201cDesignating the entire community of Fangak as hostile is deeply irresponsible and may amount to incitement of reprisals and collective punishment. This practice must end, and such designations must be rescinded immediately.\u201d<\/p>\n\n\n\n<p>The MSF hospital was the only major medical facility serving more than 40,000 people in the Old Fangak area.<\/p>\n\n\n\n<p>MSF confirmed the complete destruction of the hospital and medical supplies in the attack, which has deprived an already vulnerable population\u2014displaced and traumatized by conflict\u2014of emergency care, maternal health services.<\/p>\n\n\n\n<p>\u201cThe targeting of medical facilities is not only unlawful &#8211; it is inhumane,\u201d said Commissioner&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/hrc\/co-h-south-sudan\/bio#carlos\" target=\"_blank\" rel=\"noreferrer noopener\">Carlos Castresana Fern\u00e1ndez<\/a>. \u201cHospitals must be protected spaces, not battlegrounds.
